Terms of Service

1. Accounts and Registration

1. Users must provide accurate, current, and complete information when registering.
2. Each account is personal and non-transferable. Sharing credentials is prohibited.
3. Users are responsible for safeguarding their account login details.
4. Users must be at least the legal age in their jurisdiction.

2. Subscriptions and Packages

1. Users may select optional packages for AI credits, ad campaigns, or extra posts.
2. White-label/agency licenses and new business setup are separate, and all terms will be agreed upon during registration.
3. Users must maintain valid account information. Non-compliance may result in suspension or termination of the account.

3. AI-Generated Content

1. AI content (posts, images, videos, ads, eBooklets) created via ZenAith belongs to the user who requested it.
2. Users may use, edit, and publish AI-generated content within their business operations or for clients (if using white-label services).
3. ZenAith retains ownership of the AI models, underlying technology, and system infrastructure. Users cannot extract, replicate, or redistribute these AI models or templates outside the Platform.
4. Users agree not to sell, resell, or transfer AI-generated content for competing platforms without written consent.

4. User-Uploaded Content

1. Users retain ownership of all content uploaded to ZenAith (photos, videos, text, audio, or other media).
2. By uploading, users grant ZenAith a non-exclusive, worldwide, royalty-free license to store, process, and display content to provide Platform services.
3. Users may not upload content they do not have the rights to use. Content must not infringe on third-party intellectual property.

5. Advertising Campaigns

1. Users may create and manage ads for social media platforms through ZenAith.
2. Users retain rights to use ads for their business or clients, but ZenAith may monitor, review, and remove content that violates laws, platform rules, or intellectual property rights.
3. Users are strictly prohibited from copying, recreating, or using ZenAith-generated ads outside the Platform.

6. White-Label and Agency Licensing

1. Agencies and white-label clients are granted a license to operate the Platform under their branding for client management.
2. ZenAith retains all rights to backend systems, AI models, and technology.
3. Agencies cannot redistribute, resell, or transfer the Platform software outside their authorized use.

7. Prohibited Activities

Users may not:

• Reverse engineer, decompile, or copy ZenAith AI models or technology.
• Use the Platform for illegal, harmful, or fraudulent purposes.
• Copy, resell, or recreate ZenAith-generated content outside the Platform.
• Impersonate another user, business, or agency.
• Circumvent platform restrictions or AI credit systems.

8. Content Ownership Enforcement

1. ZenAith may review, remove, or suspend content and accounts that violate intellectual property rights, platform rules, or legal obligations.
2. Any violation may result in:
   • Account suspension or termination
   • Removal of AI-generated or uploaded content
   • Legal action for damages or injunctions
3. Users must comply with all laws regarding content, copyright, and advertising.

9. Data Collection, Privacy, and Security

1. ZenAith collects personal and business information, usage data, AI activity, and device information to operate the Platform.
2. Data is handled according to ZenAith's Privacy Policy (link).
3. Users are responsible for securing their accounts and devices.
4. ZenAith implements technical, administrative, and organizational measures to protect user data.

10. Termination of Service

1. ZenAith may suspend or terminate accounts for violations of Terms or illegal activity.
2. Upon termination, users lose access to AI tools, scheduled posts, and cloud-stored content.
3. Users retain downloaded content but must continue to comply with content ownership rules.

11. Limitation of Liability

1. ZenAith is provided "as-is." No guaranteed outcomes are promised from AI content, ads, or business growth.
2. ZenAith is not liable for lost revenue, business losses, or other damages resulting from Platform use.
3. Users are responsible for business decisions, ad budgets, and legal compliance.

12. Indemnification

Users agree to indemnify and hold ZenAith harmless from claims, damages, or expenses arising from:

• Misuse of the Platform
• Infringement of intellectual property
• Legal disputes related to content or advertising

13. Updates and Modifications

1. ZenAith may update these Terms to reflect new features, laws, or business practices.
2. Users will be notified via email or in-app notifications of material changes.
3. Continued use constitutes acceptance of updated Terms.

14. Governing Law

• These Terms are governed by South African law.
• Any disputes will be resolved under South African jurisdiction.
